California is the only state that I am aware of which has a law against the use of Butane as a solvent.
I have been informed of the law in California regarding the unsafe use of butane in a
homemade PVC styled device. I understand completely the reasoning for this law after reviewing
the archaic unsafe method, however I don’t completely understand the law as it is written or understand
why there is not a qualifier in the law for the safe use of butane as a solvent.
In addition, there are no apparent permits to allow the use of butane in a non-clandestine permitted lab in
California. No permits to operate a lab that I have been able to find.
If I moved to California and wanted to operate my lab lawfully using Butane as a solvent or any other
flammable solvent under pressure, how can I do that?
Propane is under pressure and it is used to extract oils from plants but the pressure is greater and the liquid
gas makes it harder to deal and in so doing, it becomes not as safe as butane.
Other solvents are used but are flammable in some cases and sometimes require pressure or heat to make
them efficient.
Butane is the only non toxic, controllable, safe alternative.
It is the method that makes a solvent dangerous. And it is the apparatus used that dictates the method.
With the method I employ, in the apparatus I invented, a bic lighter is far more dangerous.
In addition to being a completely closed system, the butane solvent is recovered for reuse and is never opened
to the atmosphere.
It is a GREEN Apparatus that is safe to use.
I invented the Tamisium Extractor in Texas. It is a safe lab/food grade constructed hydrocarbon (butane)
solvent capable extractor that we have been using for 5 years to commercially extract oils from plants in addition
to other chemicals in plants that do not reside in the oil. Made of Stainless Steel and machined to fit air tight.
I have been approached by many entrepreneurs and home based customers asking me to sell them this extractor
for use in your state of California. The extractor can use other solvents but without the ability to use butane, it can be somewhat limited in function.
Please clarify the law for me and if possible write a letter of legal opinion regarding the use of a Safe Butane Extractor,
such as the one I hold the patent on, when used for the purpose of extracting oils from plants.
In so doing, I feel that you will take what is already going to be done, (using dangerous methods) and place into
the hands of those people a safe method of doing what apparently is their right to do according
to CAG LLO No. 03-411 by Bill Lockyer.
I make commercial production extractors as well as table top versions for home based botanist, homeopathic
remedies, aroma therapy, fragrances and essential oils.
We are relocating our business outside of Texas and into another State. I hope to be moving back to California
when I do.
This machine can extract from a plant, a pharmaceutical grade product free of carcinogens.
A product that any state community or medical doctor would be proud to be able to offer.
In this form, the methods of ingestion are greatly increased and therefore, safer and more controllable
pharmaceutical type ingestion methods can be created. Such as inhalers, topical, and oral.
This product is much safer for the patients consuming it.
The Tamisium Extractor can do this with any plant of value. Not limited to just one type of plant.
And it can do it all without any additional equipment. But more important is the ease of use and the safe reliable design of the machine and process.
I am positive that the use of this machine in the State of California can bring much revenue to that state
or any other state.
